TERMS AMD CONDITIONS

  1. I______________________________ (the “Tenant”) agree that:

 

(a) This Tenancy Agreement (“Agreement”) is for annual rental of garden plot number _______in the Silver Springs Community Edible Garden Group (hereinafter called the “Garden” located in the Community of Silver Springs in the City of Calgary for the term March 1  to October 31. )

(b) Plots may not be registered “in name only” and must be worked by me or by persons under my direct supervision.

(c) Eacn year I must confirm my intent to rent my plot for the upcoming year and must pay the garden fee by March 1 of that year.  I understand and agree that failure to meet this deadline will result in my plot being reassigned to the next person on the wait list.  Payment must be made through the SSCA office.

(d) Plots may not be traded or sublet without written permission of the Head Gardener Group.  Each tenant gardener may request a change of plot at anytime.  Such requests may be granted at the discretion of the Head Gardener Group depending on availability of plots.

  • Only one garden plot will be allocated per household if there is a wait list. Any other arrangements may be made at the discretion of the Head Gardener Group.
  • Plots are assigned first to interested community residents. If any plots remain vacant after the last deadline, they may be assigned to non residents on a waiting list.
  • Each tenant gardener must be a current member of the Silver Springs Community Association (SSCA).
  • All tenants must volunteer in the garden a minimum of four (4) times per season.
  • Communication will be primarily through emails. If a tenant wishes to have their name removed from the distribution list, he/she must contact the IT Coordinator.

(j) Advise the Head Gardener Group if my contact information changes.

(k) Tenant’s contact information (phone numbers/email addresses) is collected exclusively for the purpose of providing this information to other gardeners so that they may contact one another for the purposes of community garden activities.  Such contact information shall not be shared by any tenant gardener with others outside the garden group nor used for unrelated matters without the express written consent of the tentant gardener whose information is requested.

(l) By signing this agreement, I consent to having any photos of myself and/or my family members being used by the Head Garden Group for any purpose related to garden activities.  If you wish to be exempt from this, you must contact the Head Gardener Group in writing and request that photos of you or your family not be used for this purpose.

  • If at any time I am not able to fulfill the terms of this Agreement or will be absent for a period of time, I will advise a Head Gardener Group.

 

  1. If the terms of Agreement are not fulfilled, the matter will be referred to the Head Gardener Group. At the discretion of the Head Gardener Group, this Agreement may be maintained, amended or cancelled. The plot, if cancelled, will be reassigned by the Head Garden Group who will determine if the fee may be returned or forfeited.

ADDITIONAL TERMS AND CONDITIONS

 

  1. I will strictly adhere to organic gardening principles and practices including:
    1. Not using chemical fertilizers, pesticides, herbicides or insecticides in the garden.
    2. Adequately diluting emulsified fish and seaweed fertilizers prior to application so as not to attract cats or other animals to the garden site.
    3. Assisting in managing compost. Following composting and mulching guidelines as provided by the Garden.  These include not adding any meat or dairy products to the compost with the exception of blood meal, bone meal and hair.  Adding no diseased plants or weeds that have gone to seed to the compost and helping to maintain a healthy, productive compost system.  Cutting organic material into small pieces so that it decomposes more rapidly.
    4. Using only soil and compost materials supplied by the Garden. Bringing no soil compost, fertilizers, manure or other additives into the garden without the express consent of  the Head Gardener Group.
    5. Hand weeding of my plot and the paths around my plot.

 

  1. I will properly maintain the plot and common areas assigned to me and I will:
    1. Respect other gardeners’ rights and not cause actions detrimental to other tenants. I will show respect for all gardeners.
    2. Take responsibility for any non-gardeners accompanying me to the site and ensure that children are supervised at all times.
    3. Have my garden plot planted by June 15 during the Term and cleaned out by October 31. Any crops I leave in my plot after October 31 may be given to a local food bank or tilled into the ground.
    4. Restrict crops which grow over 4 feet in height to a maximum row length of 4 feet so as not to shade neighboring plots.
    5. Use trellises that are stable in all weather conditions and do not shade other gardens.
    6. Deal with insect and weed infestations quickly and organically to prevent spread to other plots.
    7. Clean up any garbage or litter and remove from site.
    8. Recycle materials that can be recycled.
    9. Not bring pets into the garden with the exception of a service animal.
    10. Pick only produce from my own plot
    11. Harvest produce when it is ripe. (Share or donate excess.  Do not let it to go to seed or to waste.)
    12. Take only a reasonable share from common areas.
    13. Not smoke in the Garden nor permit any guests visiting my plot to smoke.
    14. Clean shared garden tools and put them back into the storage shed immediately after using them.
    15. Be aware that the water in the garden is not potable.

 

 

  1. Each Tenant that complies with all current guidelines and conditions will have first priority to rent a plot for the next year by registering by March 1st of the year following the end of the Term.

 

  1. Failure to comply with the above conditions may result in the termination of this Agreement and the forfeiture of any fees which have been paid.

BY SIGNING THIS AGREEMENT, I HOLD HARMLESS, INDEMNIFY AND DEFEND THE GARDEN, THE GARDEN’S VOLUNTEERS, THE SSCA AND THE SSCA’S EMPLOYEES, OFFICERS, DIRECTORS AND VOLUNTEERS FROM AND AGAINST ALL CLAIMS FOR DEATH OR INJURY TO PERSONS OR LOSS OR DAMAGE TO PROPERTY, FOR THE VIOLATION OF ANY APPLICABLE LAWS OR GOVERNMENTAL REGULATIONS, AND FOR PENALTIES AND REASONABLE LEGAL EXPENSES (INCLUDING SOLICITOR/CLIENT FEES, COSTS AND EXPENSES) WHICH RESULT FROM THE TENANT’S OR ITS USERS, REPRESENTATIVES’ OR AGENTS’ BREACH OF THIS AGREEMENT OR WILLFUL MISCONDUCT OR NEGLIGENT ACTS OR OMISSIONS IN THE COURSE OF THEIR PERFORMANCE OF TENANT’S OBLIGATIONS UNDER THIS AGREEMENT.  TENANT SHALL PROMPTLY ADVISE GARDEN AND THE SSCA OF ANY SUCH CLAIMS AND AGREES TO PAY REASONABLE SOLICITOR/CLIENT FEES, COSTS AND EXPENSES OF GARDEN AND THE SSCA INCIDENT TO DEFENSE OF SUCH CLAIMS.  GARDEN AND THE SSCA SHALL HAVE THE OPTION OF PARTICIPATING IN SUCH DEFENSE WITH ADDITIONAL COUNSEL AND AT THEIR OWN EXPENSE WITHOUT RELIEVING TENANT OR IT USERS’, REPRESENTATIVES’ OR AGENTS’ OF ANY OF TENANT’S OBLIGATIONS HEREUNDER.
